A KENTON man found guilty of gunning down a 24-year-old father-of-two to settle a gangland dispute has won the right to appeal against his conviction. an Appeal Court bid to overturn his conviction.

Romain Whyte, 28, of Woodgrange Avenue, was convicted of murdering his former friend Jahmall Moore, in what was described in court as a "gangland feud".

Whyte was sentenced to life imprisonment at the Old Bailey in 2006, and was told he would spend a minimum of 27 years behind bars.

The dispute between Whyte and Mr Moore was said to have started when the home of Whyte's girlfriend was burgled in May 2004.

By the next day, a man, known to Mr Moore, was dead.

A series of attacks followed, and Mr Moore was fatally shot in January 2005, when his car was surrounded by four gunmen.

He managed to roll out of the car and the prosecution said he stayed alive just long enough to name his killer.

Whyte's lawyers argued at the Court of Appeal yesterday, that the acquittal of two of his co-defendants, Gavin Grant and Sean Bennett, plus the fact that new telephone evidence had emerged, meant Whyte's conviction should be declared "unsafe".

Lord Justice Keene, sitting with Mr Justice Owen and Sir Richard Curtis, said: "In our judgement, this gives rise to an arguable ground for appeal."

A date has not yet been set for the full hearing of Whyte's appeal.
