A parking campaigner says Harrow Borough Council should do the 'honest' thing and pay back fines incorrectly given out on a stretch of road.

Parking campaigner Derek Dishman, also known as Mr Mustard, managed to get a fine issued to friend overturned after she was ticketed in Burnt Oak Broadway between Columbia Avenue and Camrose Avenue.

He pointed out to the council the location did not have correct signs in accordance with the legislation, overturning the parking ticket.

Since then Mr Dishman, who lives in Barnet, obtained figures under a Freedom of Information request and found 19 others had been fined for parking in the same location and had paid up, even though they should not have been ticketed.

He says the council has received payments totalling £1,105 "from motorists to which the council was not entitled and which should be repaid".

Mr Dishman said: "The council should do the honest thing and pay the money back to these people who have paid the money.

"There is no way the 19 people who have paid will know they are entitled to a refund.

"They paid the money in good faith because they believed the council was correct. But they probably don't now know the council was actually in the wrong.

"I fully accept parking fines are needed when people have done wrong. But when they haven't done anything wrong then they shouldn't have to pay.

"The thing is, the council doesn't want to admit it has done something wrong and set a precedent."

Mr Mustard is an established parking campaigner in the borough of Barnet and has helped many people overturn unjustified fines.

A council spokeswoman said: "Drivers have the option of appealing against their parking ticket and the council looks at all the evidence available when making a decision."

The sad truth is Harrow Council is a greedy council with little or no give where parking is concerned. No matter how right you are they will not relent and will enforce enforce enforce... the motto is and always has been, to enforce and if the motorist complains only then will it be looked into as Mr Mustard has done, job well done Mr Mustard we need more people like your self to take on the bullies in Harrow Council. It seem the standard pro-forma letter comes out straight away every time when you appeal, do not give up if you believe you are right keep in trying, the sooner these cash greedy people at Harrow Council learn that motorists will not put up with this the better. The CEO's in Hatch End are frequently seen to hide in the bushes by the Pizza restaurant, watch people park and then jump out and slap the ticket on as soon as the poor defensless motorist has gone into the Pizza rest or the Moons and Sixpence, Im sure the now departed caped crusader PC Hall had a lot to do with this, lets hope the Labour administration will see sense and at least look into this!

Too bad Harrow Council doesn't enforce parking regulations in St Kildas road where numerous vehicles park illegally to frequent a local barber shop. Seems like the council does not have the guts to tackle this nor do they seem willing to tackle the yellow line parking in Hindes Road outside Quainton Hall school in the afternoon. Some residents are forced to pay for a parking permit yet others park illegally and are not fined. In addition, some motorists are fined when the council is in the wrong.

Johndoe you are right are there any wardens anymore? the yellow lines outside Sacred heart/Salvatorian school in the high rd harrow weald are blatantly ignored as are the cars parked illegally every day at end of school the council seems to pick and choose who they target

Harroweveryman yes you are correct, but Harrows streets are paved with gold for the council, wtih CCTV now taking precedence over crime, you can be caught and fined without even realising, big brother in harrow is the cash cow that we all talk about!!

I established that Richmond Council had issued a total of £1.1M in unlawful fines over a two year period. When confronted Richmond upon Thames Council took the honourable and honest course. Lord True the leader of the Council who operates a fair parking policy ordered that everyone unlawfully fined should receive a proactive refund.

Quite how an authority such as Harrow can justify retaining unlawfully derived income defies belief. The penalty money does not belong to Harrow. It is clear from this that Harrow operate an unfair regime. Permanently depriving anyone of unlawfully obtained money amounts to theft pure and simple. You cannot falsely purport to be administering the law if you are breaking it yourself.

The fact is that others have already paid penalties in the honest belief that they were lawfully issued. The penalties were unlawfully issued as they were in Richmond.
